“The take parters’ decision and statement were made self-reliantly, and without conferation with the University or the fit department. The take parters’ decision also does not recurrent the position of the University,” the statement read.

“The University and its fit programs are handleed by the Nevada Constitution and Nevada law, which harshly protect identicality of rights under the law, and that identicality of rights shall not be denied or abridged by this state or any of its subdivisions on account of race, color, creed, relations, relationsual orientation, gfinisher identity or conveyion, age, disability, ancestry or national origin. The University is also handleed by federal law as well as the rules and regulations of the NCAA and the Mountain West Conference, which include providing competition in an inclusive and encouraging environment.

“The University intfinishs to transfer forward with the suit as scheduled, and the take parters may select not to take part in the suit on the day of the contest. No take parters will be subject to any team disciplinary action for their decision not to take part in the suit.”

Slusser, who uniteed the team in 2023 after transferring from Alabama, uniteed in a litigation agetst the NCAA, headed by establisher college swimmer and OutKick contributor Riley Gaines, over the handleing body’s current policies on gfinisher identity.

Slusser claimed that she had not been conscious that Fleming was transgfinisher, despite sharing rooms together on team trips, per the court records. Slusser also conveyed protectedty troubles for opponents take parting agetst Fleming. Slusser’s grumblet said that she and the other take parters on the team “could not filledy protect themselves” from Fleming’s volleyball spikes.
